Brian K. Holland is a shareholder of Recht & Kornfeld, P.C.  Brian brings over 30 years of criminal and white collar criminal defense experience to the firm, and has tried over 70 federal and state criminal cases.  He is also listed in the 2008 and 2009 edition of The Best Lawyers in America in the areas of White Collar and Non-White Collar Criminal Defense.

Since 1985, Brian has specialized in the representation of clients in federal court.  His federal court criminal trials include the defense of an attorney charged with bankruptcy fraud, one of seven Bureau of Prisons guards charged with conspiracy to assault inmates, a former Denver Nugget charged with tax evasion, and a lieutenant colonel orthopedic surgeon charged in a military court martial.  In Brian’s federal practice, he has represented executives, union trustees, government officials, and physicians indicted or under investigation.  These cases have involved the full range of federal charges, including tax evasion, fraud, securities fraud; arms export violations, environmental and prescription drug offenses. 

Brian also has extensive civil experience.  He has represented clients in federal civil litigation including Section 1983, Lanham Act product origin, Federal False Claim Act, Federal Tort Claim Act and minority shareholder diversity cases.  His Section 1983 constitutional tort litigation has included a home owner shot in his home by police officers, a young man who was raped in county jail by a sexual predator, a pretrial detainee who suffered a stroke due to negligence of the Bureau of Prisons, and a pretrial detainee who was killed in a county jail.

Brian also has substantial experience in environmental cases.  He represented Steel Workers union members during the Rocky Flats nuclear weapons plant federal grand jury investigation into clean air and clean water offenses.  He has defended clients charged in environmental indictments regarding a $7 million asbestos abatement at the Ft. Morgan High School, and the contamination of Clear Creek in Denver and the Poudre River in Greeley by waste water treatment facilities.

In Brian’s state practice, he has represented physicians and other healthcare providers charged or under investigation for a wide variety of offenses, including prescription violations and sexual abuse.  Brian also specializes in professional licensing actions, including the representation of healthcare professionals before their respective Colorado licensing boards.  Brian works extensively with co-counsel representing their clients in criminal investigations during their parallel civil proceedings.

Brian was an Assistant Federal Public Defender for three years and a Colorado State Public Defender for five years. He has served as the chair of the Criminal Justice Act Standing Committee and the National Criminal Justice Act National Panel Representative.
